Taking care of a hyperactive child at school gives 2 meanings to the word ‘care’: worrying about a vulnerable person and health care with the recognition of his behaviour disorder, the unruly pupil becomes a disabled pupil. But how does an undisciplined pupil become a psychiatric case? How do you recognise a hyperactive child at school, that is, from a medical point of view, a child with ADD/ADHD (Attention Deficient Disorder with or without Hyperactivity)? Teachers contribute to the medical diagnosis (...) by filling in behavioural tests. Then, in order to be taken care of, the child will need to have his hyperactivity recognised as a disability. To help the teacher, the doctor will give them advice on how to teach the child. Nevertheless, this desirable partnership raises difficulties. Between a paramedical support teacher and an educationalist doctor isn’t there a risk of witnessing a dilution of roles? The lifting of doctor-patient confidentiality called for by some teachers is emblematic of this confusion. Canguilhem’s distinction between normal and pathological will guide our reflection on the medical care of the hyperactive child at school. This case arouses an ethical issue about the medicalisation of our society. (shrink)

Moral duties are regularly attributed to groups. Does this make conceptual sense or is this merely political rhetoric? And what are the implications for these individuals within groups? Collins outlines a Tripartite Model of group duties that can target political demands at the right entities, in the right way and for the right reasons.

Much research on cognitive development focuses either on early-emerging domain-specific knowledge or domain-general learning mechanisms. However, little research examines how these sources of knowledge interact. Previous research suggests that young infants can make inferences from samples to populations (Xu & Garcia, 2008) and 11- to 12.5-month-old infants can integrate psychological and physical knowledge in probabilistic reasoning (Teglas, Girotto, Gonzalez, & Bonatti, 2007; Xu & Denison, 2009). Here, we ask whether infants can integrate a physical constraint of immobility into a statistical (...) inference mechanism. Results from three experiments suggest that, first, infants were able to use domain-specific knowledge to override statistical information, reasoning that sometimes a physical constraint is more informative than probabilistic information. Second, we provide the first evidence that infants are capable of applying domain-specific knowledge in probabilistic reasoning by using a physical constraint to exclude one set of objects while computing probabilities over the remaining sets. There is disagreement in the literature about the exact nature of the phenomenon of empathy. There are emotional, cognitive, and conditioning views, applying in varying degrees across species. An adequate description of the ultimate and proximate mechanism can integrate these views. Proximately, the perception of an object's state activates the subject's corresponding representations, which in turn activate somatic and autonomic responses. This mechanism supports basic behaviors that are crucial for the reproductive success of animals living in groups. The Perception-Action Model, (...) together with an understanding of how representations change with experience, can explain the major empirical effects in the literature. It can also predict a variety of empathy disorders. The interaction between the PAM and prefrontal functioning can also explain different levels of empathy across species and age groups. This view can advance our evolutionary understanding of empathy beyond inclusive fitness and reciprocal altruism and can explain different levels of empathy across individuals, species, stages of development, and situations. In a recent and provocative essay, Christopher Bartel attempts to resolve the gamer’s dilemma. The dilemma, formulated by Morgan Luck, goes as follows: there is no principled distinction between virtual murder and virtual pedophilia. So, we’ll have to give up either our intuition that virtual murder is morally permissible—seemingly leaving us over-moralizing our gameplay—or our intuition that acts of virtual pedophilia are morally troubling—seemingly leaving us under-moralizing our game play. Bartel’s attempted resolution relies on establishing the following three theses: (1) (...) virtual pedophilia is child pornography, (2) the consumption of child pornography is morally wrong, and (3) virtual murder is not murder. Relying on Michael Rea’s definition of pornography, I argue that we should reject thesis one, but since Bartel’s moral argument in thesis two does not actually rely thesis one that his resolution is not thereby undermined. Still, even if we grant that there are adequate resources internal to Bartel’s account to technically resolve the gamer’s dilemma his reasoning is still unsatisfying. This is so because Bartel follows Neil Levy in arguing that virtual pedophilia is wrong because it harms women. While I grant Levy’s account, I argue that this is the wrong kind of reason to resolve the gamer’s dilemma because it is indirect. What we want is to know what is wrong with virtual child pornography itself. Finally, I suggest alternate moral resources for resolving the gamer’s dilemma that are direct in a way that Bartel’s resources are not. (shrink)

This essay develops a form of scientific pluralism that captures essential features of contemporary scientific practice largely ignored by the various forms of scientific pluralism currently discussed by philosophers. My starting point is Hacking's concept of style of scientific reasoning. I extend Hacking's thesis by proposing the process of “ontological enrichment” to grasp how the objects created by a style articulate with the common objects of scientific inquiry. The result is “foliated pluralism,” which puts to the fore the transdisciplinary and (...) cumulative ways of proceeding in science, as well as the historical dimension of the genesis of scientific objects. In this paper, I consider a particular amoralist challenge against those who would morally criticize our single-player video play, viz., “come on, it’s only a game!” The amoralist challenge with which I engage gains strength from two facts: the activities to which the amoralist lays claim are only those that do not involve interactions with other rational or sentient creatures, and the amoralist concedes that there may be extrinsic, consequentialist considerations that support legitimate moral criticisms. I argue that the amoralist (...) is mistaken and that there are non-consequentialist resources for morally evaluating our single-player game play. On my view, some video games contain details that anyone who has a proper understanding of and is properly sensitive to features of a shared moral reality will see as having an incorrigible social meaning that targets groups of individuals, e.g., women and minorities. I offer arguments to support the claim that there are such incorrigible social meanings and that they constrain the imaginative world so that challenges like “it’s only a game” lose their credibility. I also argue that our responses to such meanings bear on evaluations of our character, and in light of this fact video game designers have a duty to understand and work against the meanings of such imagery. Stephanie Mills presented the following as the keynote address at the 2007 Annual Meeting of the International Association for Environmental Philosophy in Chicago. Mills addresses the readers of this journal in her role as a bioregional author and social critic. Adopting a narrative style rather than the typical format of the “philosophical essay,” she raises questions that are always and still at the core of our philosophical dialogue: What is nature? How do we humans perceive our relationship with nature? In Evangelium vitae, Pope St. John Paul II recognized that scientific progress would bring about new attacks on the dignity of the human person. Since that time, remarkable expansion in our knowledge and understanding of the human genome has brought forth questions of ownership rights via patents on human genes and related technology. This article argues that patenting human genes is incompatible with human dignity as it commodifies that which is priceless. In contrast, granting patents to manipulations of human genes (...) does not violate human dignity so long as it is utilized toward the common good. A surfeit of research confirms that people activate personal, affective, and conceptual representations when perceiving the states of others. However, researchers continue to debate the role of self–other overlap in empathy due to a failure to dissociate neural overlap, subjective resonance, and personal distress. A perception–action view posits that neural-level overlap is necessary during early processing for all social understanding, but need not be conscious or aversive. This neural overlap can subsequently produce a variety of states depending on the context (...) and degree of common experience and emotionality. We outline a framework for understanding the interrelationship between neural and subjective overlap, and among empathic states, through a dynamic-systems view of how information is processed in the brain and body. : A central claim of Longino's contextual empiricism is that scientific inquiry, even when "properly conducted", lacks the capacity to screen out the influence of contextual values on its results. I'll show first that Longino's attack against the epistemic integrity of science suffers from fatal empirical weaknesses. Second I'll explain why Longino's practical proposition for suppressing biases in science, drawn from her contextual empiricism, is too demanding and, therefore, unable to serve its purpose. Finally, drawing on Bourdieu's sociological analysis of (...) scientific communities, I'll sketch an alternative view of scientific practice reconciling a thoroughly social view of science (such as Longino's) with a defense of its epistemic integrity. Growing interest in embedded research approaches—where research is incorporated into clinical care—has spurred numerous studies to generate knowledge relevant to the real-world needs of patients and other stakeholders. However, it also has presented ethical challenges. An emerging challenge is how to understand the nature and extent of investigators’ obligations to patient-subjects. Prior scholarship on investigator duties has generally been grounded upon the premise that research and clinical care are distinct activities, bearing distinct duties. Yet this premise—and its corresponding implications—are challenged (...) when research and clinical care are deliberately integrated. After presenting three case studies from recent pragmatic clinical trials, we identify six differences between explanatory trials and embedded research that limit the application of existing scholarship for ascertaining investigator duties. We suggest that these limitations indicate a need to account for the implications of usual care and to move beyond a narrow focus on the investigator-subject dyad, one that better reflects the team- and institution-based nature of contemporary health systems. Classic statements of research ethics advise against permitting physician-investigators to obtain consent for research participation from patients with whom they have preexisting treatment relationships. Reluctance about “dual-role” consent reflects the view that distinct normative commitments govern physician–patient and investigator–participant relationships, and that blurring the research–care boundary could lead to ethical transgressions. However, several features of contemporary research demand reconsideration of the ethics of dual-role consent. Here, we examine three arguments advanced against dual-role consent: that it creates role conflict for the (...) physician-investigator; that it can compromise the voluntariness of the patient-participant’s consent; and that it promotes therapeutic misconceptions. Although these concerns have merit in some circumstances, they are not dispositive in all cases. Rather, their force—and the ethical acceptability of dual-role consent—varies with features of the particular study. As research participation more closely approximates usual care, it becomes increasingly acceptable, or even preferable, for physicians to seek consent for research from their own patients. The ethics of care has flourished in recent decades yet we remain without a succinct statement of its core theoretical commitment. This book uses the methods of analytic philosophy to argue for a simple care ethical slogan: dependency relationships generate responsibilities. It uses this slogan to unify, specify and justify the wide range of views found within the care ethical literature.

This chapter argues that the best way for a non-naturalist to explain why the normative supervenes on the natural is to claim that, while there are some sui generis normative properties whose essences cannot be fully specified in non-normative terms and do not specify any non-normative sufficient conditions for their instantiation, there are certain hybrid normative properties whose essences specify both naturalistic sufficient conditions for their own instantiation and sufficient conditions for the instantiation of certain sui generis normative properties. This (...) is the only metaphysical explanation for supervenience on offer, the chapter argues, that can both clearly maintain the pre-theoretical commitments of non-naturalism, and provide a metaphysical explanation not just for supervenience, but for all metaphysical necessities involving natural and normative properties. This paper provides an overview of Group Duties: Their Existence and Their Implications for Individuals.

Prehospital ambulance based research has unique ethical considerations due to urgency, time limitations and the locations involved. We sought to explore these issues through interviews with experts in this research field. We undertook semi-structured interviews with expert informants, primarily based in the UK, seeking their views and experiences of ethics in ambulance based clinical research. Participants were questioned regarding their experiences of ambulance based research, their opinions on current regulations and guidelines, and views about their general ethical considerations. Participants were (...) chosen because they were actively involved in, or in their expert capacity expressed an interest in, ambulance based research. Fourteen participants were interviewed including principal investigators, researchers, ethicists and medical lawyers. Five major themes were identified: Capacity, Consent, Clinical Considerations, Consultation and Regulation. Questions regarding consent and capacity were foremost in the discussions as all participants highlighted these as areas for concern. The challenges and use of multiple consent models reflected the complexity of research in this environment. The clinical theme referred to the role of paramedics in research and how research involving ambulance services is increasingly informing improvements to patient care and outcomes and reducing the burden on hospital services. Most felt that, although current regulations were fit for purpose, more specific guidance on implementing these in the ambulance setting would be beneficial. This related closely to the theme of consultation, which examined the key role of ethics committees and other regulatory bodies, as well as public engagement. By interviewing experts in research or ethics in this setting we were able to identify key concerns and highlight areas for future development such as improved guidance. (shrink)

Discussions about the impacts of marketing systems on society have been strongly encouraged in the field of macromarketing. However, these studies have focused on analyzing human and organizational actors, neglecting, to a large extent, the impacts of practices of marketing systems on other non-human stakeholders, such as those associated with or materialized in the form of a product. This article debates the material basis of the product of animal origin based on the concepts of justice, stakeholder theory, and externalities. An (...) argument was developed attributing the status of a moral agent to the animals used to make products and focusing on this debate, arguing for the establishment of a consumption pattern that morally considers animals. This was made feasible by new alternatives for food performances exemplified by the conduct of vegetarian and vegan consumers. (shrink)

A partir de l'étude de la pratique de certains artistes et de l'analyse de textes philosophiques, il s'agit de décrire une passivité de forme particulière, une passivité "opérante", corrélative d'une forme dynamique de la subjectivité. Cette passivité, "dimension d'un mouvement dont je suis le médiateur, mais qui d'une certaine façon se fait en moi sans moi, à mon insu", de nombreux artistes du 20. siècle s'en sont faits les témoins (Arp, Bacon, Dubuffet, Klee, Michaux, Rauschenberg, Schwitters, Spoerri, Nicolas de Staël, Bram Van Velde...), appelant aussi cette expérience "inconscient", "hasard", "imprévu", "surprise". Dans la perspective esquissée ici, l'accès aux autres cesse alors d'être un "problème". L'autre a déjà sa part dans mon expérience la plus singulière. The conflicts of interest that may arise in relationships between academic researchers and industry continue to prompt controversy. The bulk of attention has focused on financial aspects of these relationships, but conflicts may also arise in the legal obligations that faculty acquire through consulting contracts. However, oversight of faculty members' consulting agreements is far less vigorous than for financial conflicts, creating the potential for faculty to knowingly or unwittingly contract away important rights and freedoms. Increased regulation could prevent this, but (...) it is unclear what forms of oversight universities view as feasible and effective. In this article, we report on a Delphi study to evaluate several approaches for oversight of consulting agreements by medical schools. The panel was comprised of 11 senior administrators with responsibility for oversight of faculty consulting relationships. We found broad agreement among panelists regarding the importance of institutional oversight to protect universities' interests. There was strong support for two specific approaches: providing educational resources to faculty and submitting consulting agreements for institutional review. Notwithstanding the complexities of asserting authority to regulate private consulting agreements between faculty members and companies, medical school administrators reached consensus that several approaches to improving institutional oversight are feasible and useful. Semen Frank is one of the most interesting and exciting pre-revolutionary Russian religious philosophers to be “rediscovered” after the fall of the Soviet Union. His involvement in Russian pre-revolutionary political and academic life brought Frank into contact with an imaginative, progressive and idealistic group of thinkers whose ranks he then joined. Like Nicholas Berdyaev and Fr. Sergei Bulgakov, Frank put forward his own philosophical views about their world, which was in upheaval, and about human nature. After emigration from the then (...) young Soviet Union, Frank continued to produce his impressive body of work. His ideas are remarkable for their considered, moderate and tolerant nature.This book is a contribution to the ever-growing body of scholarship, which strives to connect Russian thought to its contemporary Western context and continues to facilitate the revival of these fascinating thinkers. In addition to situating Frank’s thought in a Western context, this work seeks to provide an overview of his thought, and introduce his key arguments to those unfamiliar with Russian religious philosophy. Theben noch als sakraler Ausdruck = παρθνος' ; ‘A Thèbes d'Égypte pour désigner une prêtresse = παρθνος' . Pubescent temple-prostitutes had no place in Hellenic religious life, and it might be thought surprising (...) that there was a Greek word for them; yet Strabo offers the term without explanation or speculation as to derivation or dialectal provenance, apparently confident that it is indeed Greek and not a foreign loan-word. The Greeks who frequented Upper Egypt were not a group of largely homogeneous origin, who might have preserved in quasi-colonial isolation an archaism obsolete elsewhere in the Hellenic world. No such usage is mentioned in ancient discussions of the derivation of Pallas, wide though the etymological net is cast in the attempt to explain Athene's title: see, e.g., sch. Il. 1.199–200 , sch. The philosophical literature on personal relationships is focused on dyads: close relationships between just two people. This paper aims to characterise the value of looser and larger relational networks, particularly from the perspective of liberal political theory. We focus on relational networks' value vis-a-vis the important good of felt security. We begin by characterising felt security and analysing how felt security is produced within dyads. We highlight the ambivalent nature of dyadic relationships as a source of felt security. We then (...) theorise relational networks, explaining how they too can provide felt security. We explore three unappreciated benefits that arise when felt security is garnered from a network, rather than from a dyad. These benefits take liberal political theory as their starting point. We close by considering the implications - for both individual action and institutional design - of using relational networks as a source of felt security. (shrink)
